    International Department

The International Department of EDGE provides legal solutions for both individuals and companies with expertise in four main areas of practice: Tax; Property; Wills and Probate; and Aviation and Insurance. In addition to this, the Department also assists with company/association set up and ongoing advice.

    Private Clients
Within the Tax, Property and Wills/Probate areas there is a strong emphasis on providing solutions for Private Clients investing in, and moving to, Portugal. We provide tailor-made packages with individualised fee structures as we understand that a one-size-fits-all approach is not suitable when our aim is to truly understand our clients’s needs. Combining traditional Private Client law firm values with a proactive, constructive approach has allowed us to retain several international families for generations, alongside Embassies in Portugal. The team are bilingual Portuguese and English speakers and fluent in French and Spanish.

Having successfully advised, registered, and assisted many European and non-European clients since the inception of the NHR (Non-Habitual Tax Residence) programme our team has a earned a reputation for being the leading expert in the NHR legislation. Alongside registration we assist with structuring to derive the maximum benefit from the programme, personal taxation issues, succession tax and long-term tax planning.

The team has seen a significant increase in demand for the NHR programme from across the globe as both Europeans and non-European clients have sought to relocate to maximise the tax efficiency. The focus on lifestyle, flexible working, digital nomads, political and economic shifts, increased exchange of information and Brexit have also produced a noticeable growth in interest.

We are key members of the international tax network RBB International a network of independent tax and business advisors with representation in Western Europe, North America and North Africa.

The department has a strong focus on property work, particularly: bespoke property advice for both buyers and sellers; high calibre advice for public institutions; individualised advice for investors buying and selling property; advice on all aspects of the property development process; specialist advice by experienced and Post Graduate Lawyers in Planning and Tourism Law.

The initial objectives of the team are two-fold on property matters: providing a solution focussed Report on Title; and advising on the most appropriate structure for a purchase or sale. Subsequently, the team will guide the client through each stage of the purchase and sale process to completion and through post-completion using a Power of Attorney. As a result, we
can represent clients at the key stages of the transaction without their presence.

    Wills and Probate
The legal work of the Wills and Probate team complements the other areas of practice in the department. We are able to guide clients in the process of drafting and executing their Wills in the correct manner, seeking wherever possible to enable their choice of succession law. We also have a service of reviewing existing Wills and holdings original Wills for safekeeping. As a result, we have handled the estates, and have been appointed executors for, a number of families which have been established in Portugal for centuries. Finally we assist with the full range of the Probate procedure, dealing with each step in the process of releasing the assets of the estate to the heirs through a Power of Attorney.

    Aviation and Insurance
The aviation practice covers a large number of areas including: aircraft financing and leases; aircraft, ship and vehicle registration; aircraft ownership schemes including fractional ownership; tracing and recovery of aircraft; regulatory issues; general civil liability issues; contractual issues; coverage disputes; and passenger and cargo claims. We represent a wide variety of international airlines and insurers in the London and other key markets.

    Company/business set ups
A number of clients require Portuguese company set-ups to complement their property purchases or, indeed, to start up their operations in Portugal and this is something which we facilitate, providing initial tax advice as required. We have also advised on a series of medium to large acquisitions in the real estate, tourism and education sectors.

    The team
The International Team consists of experienced Portuguese Lawyers and English solicitors.
